Carrie Coakley, the alleged dominatrix and sex-club owner who is accused of playing a central role in the massive mortgage scam that sunk Suffolk County Legis. George Guldi, suffered another defeat in court Tuesday -- though it was of a more mundane kind.

Coakley lost her bid to prevent a mortgage company from foreclosing on her Southampton property, located at 98 Bridies Path, when New York's highest court threw out her appeal.

Coakley did not contest the fact that she'd defaulted on a $1.45 million loan she took out in 2005 to acquire the parcel -- which is one of the more than five dozen properties that prosecutors said is involved in the mortgage scam. Instead, she had claimed that the mortgage had been improperly sold to Saxon Mortgage Services of Texas, which therefore couldn't foreclose on her. The Court of Appeals dismissed Coakley's case, upholding rulings by lower courts.

Coakley and her husband, Donald MacPherson, are among the other defendants in what prosecutors allege was an $82 million mortgage fraud that ensnared Guldi.

Last month, Guldi was sentenced to 1 to 3 years in prison after he admitted committing dozens of frauds by diverting money to himself and his co-defendants by using straw buyers to obtain fraudulent mortgages on more than 60 properties across Suffolk County.

Prosecutors allege that many of the straw buyers were recruited at The Dungeon, a sex club in Manhattan, where Coakley was in charge.

A grand jury indicted Coakley on one count of first-degree grand larceny and one count of scheming to defraud, said Suffolk County District Attorney spokesman Robert Clifford. MacPherson faces four counts of insurance fraud and six counts of criminal possession of a forged instrument.

Their case is scheduled for a court conference with attorneys in October, Clifford said.

Irwin Popkin, Coakley's Melville-based lawyer, said he was not aware of the ruling in the foreclosure case and would not comment.
