Lawyer: White to surrender, begin serving prison sentence

John White, the Miller Place man convicted of fatally shooting a Selden teenager during a 2006 confrontation outside White's home, is to surrender Thursday morning to begin serving his 2- to 4-year prison sentence, his attorney said Wednesday.

White, 56, a carpenter, was ordered by state court officials to appear before County Court Judge Barbara Kahn for an "execution of sentence" in Suffolk County Court in Riverhead.

"There will be a surrender then," said White's attorney, Frederick Brewington of Hempstead. He declined further comment.

White, who was convicted in December 2007 of second-degree manslaughter for shooting Daniel Cicciaro Jr., 17, in August 2006, has been free on $200,000 bail while he appealed his conviction.

He apparently lost his last chance to have the conviction overturned when the Court of Appeals, the state's highest court, last week refused to hear his appeal.

The high-profile case began, police and prosecutors have said, when Cicciaro and his friends went to White's home in search of White's son, Aaron, whom they mistakenly believed had threatened to rape a girl at a party they attended that night.

In a confrontation at the end of White's driveway on Independence Way, White shot Cicciaro. From the beginning, the case was racially charged, as White is black and Cicciaro was white.

White's attorneys argued at his trial that he shot Cicciaro in self-defense. Prosecutors countered that White should have stayed inside his house and waited for police.

In May, a state appeals court declined to overturn White's conviction. The state Court of Appeals on June 29 refused to hear White's appeal.
