A Bay Shore man was charged with aggravated drunken driving under Leandra's Law on Saturday when State Police said he was driving drunk with his two children in the car.

Police said they saw Jose Guevara, 36, driving a 2000 Nissan minivan erratically north on Sagtikos Parkway near Crooked Hill Road. The vehicle was drifting in and out of its lane, striking the curb in the center median, they said.

After Guevara was told to pull over, police determined that he was driving drunk with two children in the car.

Guevara was arrested and charged with aggravated drunken driving with child in the car, and endangering the welfare of a child, a misdemeanor.

The children were released to their mother.

Leandra's Law is named for Leandra Rosado, 11, who was killed in October 2009 when the van she was riding in overturned on the Henry Hudson Parkway in Manhattan. The driver pleaded guilty to DWI and manslaughter charges.

The law makes it a felony, even on first offense, to drive while intoxicated or ability impaired by drugs with a child under age 16 in the car.
