Southampton Town police said a Hampton Bays man who failed to stop for a police officer directing traffic at a railroad crossing gate malfunction on Ponquogue Avenue in Tiana Sunday night is under arrest, charged with driving while intoxicated.

Southampton Town police said the incident occurred at 9:40 p.m. Sunday. It was then that Luis Rojas, 34, disregarded the directions of an officer directing traffic at the grade-level Long Island Rail Road crossing - after the gates malfunctioned, police said.

The officer directed Rojas to stop, but failed to do so and proceeded onward, police said.

Police stopped Rojas a short distance later. There he was found to be intoxicated, police said, and was arrested.

He is scheduled for arraignment Monday.
