Even in prison, Daniel Pelosi can't stay out of trouble.

Still, he won a small victory last week when a Suffolk Family Court judge ruled that his wife didn't need an order of protection against him.

Pelosi, 48, is serving 28 years to life in prison for the 2001 bludgeoning death of millionaire financier Theodore Ammon in East Hampton, a murder that attracted national attention.

Pelosi, an electrician, was having an affair at the time with Ammon's estranged wife Generosa, whom he married several months after the killing. She died of cancer in 2003.

The new trouble comes by way of allegations made by his wife, Jennifer Zolnowski, who said he shoved and choked her during conjugal visits at Elmira Correctional Facility from December 2009 to October 2010, court papers say.

As a result, Pelosi was transferred to Southport Correctional Facility and thrown in solitary confinement in November for a year, said his attorney, James Reddy of Lindenhurst.

Zolnowski, 33, got an order of protection against her husband in April, days after he filed for divorce on the grounds of adultery, according to court papers.

Last week, however, Judge Joan Genchi ruled that Zolnowski didn't need the order. Zolnowski is safe from Pelosi as long as she doesn't travel 300 miles to the prison to meet with him, Genchi ruled.

If Pelosi, formerly of Manorville, continues to send threatening letters to Zolnowski, she can notify the prison warden, Genchi wrote.

As for Pelosi, Reddy said, "He's not doing well."

He spends 23 hours a day in an 8-by-7-foot cell with nothing but reading material.

Zolnowski's attorney declined to comment.
