W. Islip woman charged with DWI with child in car

A West Islip woman was arrested Saturday under Leandra's Law after she allegedly drove drunk on the Southern State Parkway, state police said.

Jacqueline M. Scuderi, 45, was operating a 2009 Chevrolet in an erratic manner, police said, when she was stopped near Exit 38, Belmont Lake State Park.

Police said an investigation revealed Scuderi to be intoxicated with her 11-year-old daughter in the vehicle. Scuderi was taken to the Farmingdale station where she provided a breath-analyzer sample of 0.17 percent, police said.

Scuderi is charged with aggravated driving while intoxicated, endangering the welfare of a child and other traffic violations.

Under Leandra's Law, passed in November, the endangerment charge is a felony. The law was passed after the death of Leandra Rosado, 11, who was killed in an alleged DWI accident after the minivan in which she was a passenger crashed on the West Side Highway. The law makes it a felony to drive while intoxicated with anyone under 15 years old in the vehicle.

Scuderi is scheduled to be arraigned in First District Court in Central Islip.

The child was released to her father, police said.
