Developers who took the Town of North Hempstead to court over a proposed retail building in Greenvale have received approval to move ahead with a scaled-down version of their project.

In 2010, Green Cove Associates Llc proposed a new 10,000-square-foot building on the southwest corner of Northern Boulevard and Town Path. The site is on a 5.26-acre parcel where a shopping center with a T.J. Maxx store is located.

The town board, however, imposed a condition recommended by the Nassau County Planning Commission to limit the building to 6,800 square feet in order to maintain a 22-foot landscaped buffer, according to court documents.

The developer sued the town, seeking to have that condition removed.

In a decision dated Sept. 20, 2011, the state Appellate Division, Second Department, found that the town board had the right to reduce the square footage of the building.

The town board held a public hearing Tuesday night on an amended site plan that included a landscape plan, a 6-foot fence and a permanent irrigation system. The board then unanimously approved the new site plan.
