The state’s highest court has agreed to hear an appeal by the Village of Kings Point over its bid to use 5.4 acres within a park for a public works facility.

The New York State Court of Appeals, which took only 64 cases last year, agreed June 4 to hear the village’s appeal.

Several Great Neck residents and New York State sued the village after it announced in 2008 plans to build a facility for its Department of Public Works on a wooded site in Kings Point Park. The residents and state argued that parkland cannot be taken over for non-park use.

The village argued that the parcel had not been used for park purposes for decades, and that the statute of limitations had run out for a suit, but it lost before the State Supreme Court and the appellate division.
