LIRR erring on side of caution

I read with disbelief of Kimon Stathakos' lawsuit against the LIRR for suspending service during several of this winter's snowstorms ["Rider to LIRR: I want refund," News, March 10].
My question is, if he boarded a Long Island Rail Road train during a snowstorm and it derailed because of icy track conditions, would he bring action, as well, against the railroad for failing to suspend service during treacherous and dangerous conditions?
No one likes their daily routine interrupted, but once in a while, we all must acknowledge acts of nature and, with common sense and good judgment, make the best of them.
