The fight between Rep. Charles Rangel and state Sen. Adriano Espaillat over last week's Democratic primary carries on.

After a brief court appearance Monday, Espaillat's attorney said he would be refilling a lawsuit against the city's Board of Elections claiming it did not properly count the votes last week.

Rangel, 82, has an 800-vote lead over Espaillat, 57, for the newly created 13th Congressional district that includes parts of Harlem and the south Bronx. The BOE still has to tally 2,000 absentee ballots.

The “Harlem Lion,” who is trying to get a 22nd term in the House, has stayed quiet about the close victory until Monday morning. In an e-mail to his supporters, Rangel asked for money to cover any legal fees associated with the pending court action.

"Would you please consider making a contribution of $10.00 or more?" he wrote. "Your financial help will allow me to receive legal counseling for the bumpy roads ahead."
