Greg Kelly won't be charged in rape accusation: DA

The Manhattan District Attorney's office will not press charges against Fox 5 anchor Greg Kelly in the sex assault case brought against him two weeks ago, amNewYork has confirmed.

"After reviewing all of the evidence, we have determined that the facts established during our investigation do not fit the definitions of sexual assault crimes under New York criminal law," wrote Martha Bashford, chief of the DA's Sex Crime Unit, to Kelly's Lawyer, Andrew Lankler, Tuesday. "Therefore, no criminal charges are appropriate."

Lankler provided a copy of the letter to amNewYork Tuesday night. A spokeswoman from the DA's office confirmed it had been sent, and that it had notified the complainant.

"From the moment this matter was referred to this Office, we conducted a thorough investigation, consistent with standard practice," wrote spokeswoman Joan Vollero in an email. "That investigation included interviewing numerous fact and expert witnesses, and reviewing and analyzing multiple items of physical evidence, including, but not limited to, receipts, security logs, text messages, and telephone records."

Through his lawyer, Kelly, the son of Police Commissioner Ray Kelly, denied the allegations made by the unidentified 29-year-old paralegal who claimed he assaulted her in October in her office after drinking at a South Street Seaport bar.

The case was sent to the DA's office to avoid any conflict of interest.

Lankler did not comment further.

A spokesman for Fox 5 did not immediately return comment Tuesday night.

Kelly had taken a leave of absence from "Good Day New York" since the accusations became public.
