Lindsay Lohan won't be in court Wednesday because she's sick: Report

Lindsay Lohan is skipping out on court Wednesday because she's a little under the weather, according to published reports.

Lohan was due in court in Los Angeles for a hearing stemming from charges that she allegedly lied to cops being behind the wheel when her Porsche crashed into a truck in June.

But a Park Avenue doctor diagnosed the starlet with an "upper respiratory infection," preventing her from flying to California to be in court, TMZ.com reported yesterday.

Her new attorney, Mark Heller, submitted the documents and a doctor's note to the judge saying that Lohan, 26, wouldn't being court, along with a newspaper article saying that New York is under a flu epidemic, TMZ said.

But her sick excuse has been drawn into question, as TMZ also published a photo of Lohan on a shopping spree in SoHo last Saturday, the same day she was supposed to have had her doctor's visit. The report also said Linz was seen smoking cigarettes.

If the judge isn't convinced, a warrant could be issued for LiLo's arrest.

Heller and Lohan's spokesman didn't respond to a request for a comment.
