A police officer was busted for allegedly driving drunk Sunday morning.

Daniel Smith, 26, was arrested at approximately 8 a.m. on Staten Island, according to police. An NYPD spokesman said Smith, who was off-duty, was arrested after being involved in a "minor" traffic incident and refusing to take a Breathalyzer test at the scene. No injuries were reported.

The Staten Island District Attorney’s office said Smith would likely be arraigned Monday on charges he was driving while intoxicated. An attorney for Smith was not listed in court records.
