Former state Senate majority leader Pedro Espada Jr. will be retried on charges that were not resolved by a jury on Monday, a source familiar with the case said Tuesday.

Espada was convicted on Monday of stealing more than $500,000 from a Bronx health clinic he founded, but the jury deadlocked on four other felonies. Prosecutors said Espada blew the money on vacations, gifts, parties and home improvements for himself and friends.

Espada's defense countered that all of his spending was approved by the clinic's board, and that he was only being targeted because of past political disputes in Albany.

Prosecutors also intend to retry Espada's son, Pedro Gautier Espada, on theft and conspiracy charges that jurors deadlocked over, and will pursue a separate case in Manhattan federal court charging the former senator with tax crimes.

U.S. District Judge Frederic Block ordered prosecutors to make an official decision on whether to they would retry the men by June 5.

Espada faces up to 10 years in prison on each of the four felonies that he has already been convicted of, but his attorney said an appeal is likely.
