Religious group files suit in Albany against same-sex marriage

A day after hundreds of same-sex couples said “I do” during Sunday’s debut of marriage equality in New York, a nonprofit religious group Monday filed suit upstate to annul the marriages and overturn the law.

The New Yorkers for Constitutional Freedoms claims the run up to the Senate vote in June to legalize gay marriage was fraught with constitutional violations.

“Today we are asking the court to intervene in its rightful role as the check and balance on an out-of-control State Legislature,” the Rev. Jason McGuire, the group’s executive director, said in a statement.

According to the complaint filed Monday in Livingston County, certain Senate procedures were overstepped and lawmakers violated open meetings laws. Gov. Andrew Cuomo also did not allow the bill to sit in review for three days before the vote, the suit said.

Cuomo spokesman Joshua Vlasto said “the plaintiffs lack a basic understanding of the laws.” Senate majority leader Dean Skelos and state Attorney General Eric Schneiderman declined to comment.
