Spanish train driver was on phone at time of crash

The driver of the train that derailed in northwestern Spain last week, killing 79 people, was talking on the phone with state train operator Renfe at the time of the accident, a court said Tuesday after analyzing the train's data recording devices.

The eight-car train had slowed from 119 mph to 95 mph just before it derailed on a curve where the speed limit is 50 mph, according to the two black boxes.

Francisco Garzon, 52, has been charged with negligent homicide.

Sixty-six people remained hospitalized from the crash, with 15 in critical condition.
