Sheldon Silver retrial date tentatively set by judge

Manhattan U.S. District Judge Valerie Caproni on Tuesday scheduled the retrial of former Assembly Speaker Sheldon Silver for April 16 of next year if the U.S. Supreme Court has finished any review of the case.

Silver, 73, had his 2015 conviction on corruption charges reversed by the 2d U.S. Circuit Court of Appeals, which ordered a retrial.

But Silver is asking the Supreme Court to bar any retrial and just throw out the case, and Caproni is barred from re-trying him until that request is resolved.

The tentative date would make Silver’s one of three Albany corruption trials occurring next year, including the scheduled trial of Joseph Percoco, a former top aide to Gov. Andrew M. Cuomo.
