Would be ex-con indicted for 2009 rape and murder

A DNA match led to the grand jury indictment of a convicted felon Thursday for allegedly raping and murdering a 23-year-old Astoria woman in 2009, according to the Queens County District Attorney.
Jose Martinez, 30, faces up to 25 years to life if convicted in the rape and murder of Carmen Saldana.
According to the indictment, Saldana, an FIT student, was walking home alone when Martinz joined. When Saldana refused to allow him in, Martinez kicked down her apartment door and raped and murdered her, according to the Queens District Attorney.
DNA evidence was collected and placed in a database.
Martinez was required to provide a DNA sample after pleading guilty to first-degree reckless endangerment in a case that involved the attack of a cab driver at LaGuardia Airport in 2011. He was sentenced to three years in prison and scheduled to be released Thursday, according to the DA.
