Yankee Stadium servers say they're cheated out of tips: lawsuit

Three food servers at Yankee Stadium yesterday filed suit against the stadium’s concessionaire, claiming it’s cheating them out of their tips, published reports said.

According to the suit filed in Manhattan federal court, the concessionaire, Legends Hospitality, automatically includes a 20 percent service charge on top of menu prices. The menu states that “additional gratuity is at your discretion,” which plaintiffs’ lawyers argue that it implies the tip is already included. The attorneys said only about 25 percent of the fans therefore end up leaving a gratuity, so servers earn less tips than they deserve.

A Legends spokeswoman said its employees are properly paid according to their contract.
