The case against a retired New York City police officer accused of killing a 26-year-old man during a road-rage incident in upstate New York is headed to a grand jury.

The Press & Sun Bulletin reports that a Bainbridge town judge decided Friday there was probable cause that 56-year-old John Guzy committed second-degree murder in the shooting of Derek Prindle. A grand jury will hear the case in November.

Police say Guzy fatally shot Prindle and wounded his 60-year-old father, also named Derek, in the parking lot outside a gym in the Chenango County town of Bainbridge on Monday.

Guzy remains in jail without bail. Assistant Public Defender Aaron Dean said Guzy will plead not guilty.

Dean said Guzy, a Chenango County corrections officer since June, chose not to testify at Friday's hearing.
