Town of Oyster Bay nixes parking limits on two commercial properties

The Oyster Bay Town Board yesterday moved to rescind restrictive covenants on commercial properties in Jericho and Plainview.

The board voted to rescind limits on parking at a gas station at 98-100 Jericho Tpke. in Jericho because the land has been purchased by the adjacent Westbury Jeep dealership. The company plans to demolish the gas station and use the property to park 40 vehicles.

The covenants were imposed by the town board in 1963 when it granted permission for construction of the gas station, most recently operated by Cumberland Farms.

The board also directed the town clerk to schedule and advertise a hearing to remove covenants established in 1997 for the property at 1082 Old Country Rd. in Plainview.

The former site of a Burger King Restaurant has been taken over by Panera Bread. When the town board approved the Burger King, it set limits on the use of the indoor playground. There will be no playground in the Panera Bread facility, so the property owner sought to have the covenants rescinded.
