A judge has scheduled a hearing next week to discuss how Roger Clemens can defend against former teammate Andy Pettitte, who claims Clemens admitted using performance-enhancing drugs.

Prosecutors argue defense lawyer Rusty Hardin has a conflict because he briefly represented Pettitte and Clemens in December 2007, before the release of a report alleging both players used human growth hormone.

Prosecutors say Hardin shouldn't cross-examine Pettitte when they call him as a witness at a trial scheduled for July. They say that should be handled by another Clemens attorney.

U.S. District Judge Reggie Walton on Tuesday scheduled a hearing on the issue for Feb. 2 and ordered Clemens to attend.

Clemens denies using drugs. But Pettitte admits doing so and says Clemens admitted privately he did as well.

Baldelli retires, takes job

Tampa Bay Rays outfielder Rocco Baldelli has retired and accepted a position as a special assistant with the team.

The 29-year-old spent six of seven seasons with the Rays. In 519 career games with Tampa Bay and Boston, he hit .278 with 60 homers and 262 RBIs.

Baldelli played in just 10 games last season. He missed all or parts of four seasons because of injuries. In 2008, he was diagnosed with mitochondrial disorder, a condition that causes muscle fatigue.

Baldelli will be involved in scouting and player development in his new job as special assistant to baseball operations.

Cueto deal done

Johnny Cueto took a physical and finalized a four-year, $27-million contract that allows the Cincinnati Reds to avoid arbitration with the righthanded starter . . . San Diego and infielder Jorge Cantu, who played for Florida and Texas, have reached agreement on a one-year contract . . . Catcher Miguel Montero has agreed to a one-year, $3.2-million contract with the Arizona Diamondbacks, avoiding arbitration. - AP
