No appeal in Clemens access decision
Former Sen. George Mitchell's law firm will not appeal the judge's decision that it must give Roger Clemens access to some of its interview notes, a lawyer for DLA Piper said in a court filing on Friday.
An appeal would have potentially jeopardized the start of the former Yankees pitcher's perjury trial next month. Jury selection is scheduled to begin July 6 in Washington, D.C.
U.S. District Judge Reggie Walton ruled Thursday that the authors of the Mitchell Report must hand over to Clemens the portions of their 2007 interviews with his longtime trainer Brian McNamee and convicted steroids dealer Kirk Radomski that mention the pitcher.
In a separate filing Friday, Walton said lawyers from DLA Piper have until Monday to hand over those notes to Clemens.
McNamee said in the Mitchell Report that he injected Clemens with performance-enhancing drugs in 1998, 2000 and 2001. Clemens denied those assertions under oath before a congressional hearing in 2008, which is the crux of his upcoming perjury trial.
If convicted, Clemens faces from 15 to 21 months in prison.
