A lawsuit that accuses Giants quarterback Eli Manning of passing off unused helmets to be marketed and sold as game-used can proceed, a New Jersey Superior Court judge ruled on Wednesday. Manning’s attorneys had filed a motion last year seeking to dismiss the fraud and racketeering claims facing the quarterback.

The civil lawsuit, first filed in January 2014 by sports memorabilia entrepreneur Eric Inselberg, also accused the Giants of pressuring their equipment managers to lie about memorabilia they gave Inselberg during a grand jury investigation. Those charges were dismissed.
