Braylon Edwards' DWI case was delayed yet again when the Jets receiver failed to appear at a scheduled hearing in Manhattan Criminal Court Monday morning. In Edwards' absence, his attorney, Peter Frankel, was granted a request for a pretrial hearing July 22.
"We're always talking about possible resolutions to the case," Frankel said, "but it's moving forward toward trial." He said he would produce "at least a dozen witnesses" on Edwards' behalf.
Frankel told Judge Matthew Sciarrino that Edwards had been working out with other Jets in Los Angeles and "planned on being here, but he had flight issues." Although Frankel asked to schedule the hearing for the last week of July, when training camp will be in session if the NFL lockout is over, Sciarrino answered that "June 3 is looking like a pretty good date."
They then settled on July 22.
Though Edwards was required to appear Monday, Frankel said he didn't believe Sciarrino was upset by the player's absence. "I think," Frankel said outside the courtroom, "that the judge understands that these things happen."
Edwards was arrested and charged Sept. 21, when a Breathalyzer test found a blood alcohol level of .16, twice the legal limit. The case was adjourned three times previously for the defense to file a series of motions, while there continue to be ongoing talks of a possible plea deal, according to Frankel.
Frankel said he would bring witnesses -- "individuals who were in the cars, others who were talked to that night, experts" -- to contest why Edwards was stopped by police, the handling and accuracy of the breath test and comments "allegedly made at the time."
"I think we have somewhat different views of the evidence," he said.
At the time of his arrest, Edwards, 28, was serving 18 months' probation based on a no-contest plea for allegedly punching a man outside a Cleveland nightclub in October 2009, shortly before Edwards was traded to the Jets from the Browns.
