Source: Edwards was fined $200,000 for incident last October
Braylon Edwards is in hot water over this morning's DUI arrest in Manhattan, and his situation could become even more complicated as the result of an arrest last October for punching a friend of LeBron James outside a nightclub in Cleveland.
Edwards pleaded no contest in January and is on probation. It's uncertain whether today's arrest violated the terms of that probation. But Edwards was disciplined by the league as a result of his plea; a source familiar with Edwards' situation said he was fined one game check - or $200,000 - by NFL commissioner Roger Goodell.
Under terms of the league's collective bargaining agreement, a player cannot be suspended for a first DUI arrest. DUI's fall under the league's substance abuse policy, and the commissioner handles discipline in these matters. A first-offense DUI limits punishment to a maximum $50,000 fine, unless there are aggravating circumstances - i.e. injuries, prior history of the player.
The league has repeatedly proposed to the union in recent years that the level of discipline for first DUIs should be a multi-game suspension - up to a maximum of four games - but the measure has been rejected by the NFL Players Association.
In Edwards' case, since he was fined over the misdemeanor assault incident in Cleveland, he could be viewed as a repeat offender under the personal conduct policy if he is convicted of DUI. But that can only occur once Edwards' DUI case is resolved, so league-enforced discipline would likely have to wait.
While Edwards can't be suspended for Sunday's game against the Dolphins, the Jets can de-activate him for conduct detrimental to the club. It is uncertain whether the DUI would constitute grounds for de-activation.
