Kris Humphries wants to forget he was ever married to Kim Kardashian: The NBA pro Wednesday filed for an annulment rather than grant her the divorce she seeks.

In his Los Angeles County Superior Court filing, Humphries, 26, checked the box for "nullity of voidable marriage," giving the standardized reason as "fraud," People magazine said. He and the reality TV star married in a much-hyped, televised wedding extravaganza on Aug. 20, only to see her file for divorce 72 days later.

TMZ.com said Humphries contends that Kardashian, 31, defrauded him into a staged marriage. Kardashian, however, is telling friends she did not defraud Humphries and married out of love, the site said. Ironically, reported People, Kardashian had originally wanted an annulment, but her attorneys had argued against it.

Under California law, fraud is one of the limited grounds on which a marriage can be annulled, along with duress, mental illness, impotency, lack of assent to the marriage, underage marriage, bigamy and consanguinity -- marriage between close blood relations. Some attorneys argue no community property is amassed in a voided marriage.

That would impact any community-property claims Humphries might make. While the couple had a prenuptial agreement, TMZ said, Humphries -- who is represented by the same Minnesota attorney, Lee Hutton, who negotiated the prenup -- claims there are "community and quasi-community assets" that should be equally divided.
