Bayville man was DWI with son, 11, in car, police say
A Bayville man was arrested Friday night after he was found to be driving drunk with his 11-year-old son in the car, Nassau County police said.
Police said they responded to a call for a car accident at 9:36 p.m. at Cold Spring Road and South Woods Road in Syosset. When they arrived, police said, they found a 2008 Lexus that had collided with a utility pole. The driver, Philip Briguglio, 50, of 18 Merritt Lane, who had a strong odor of alcohol and was unsteady on his feet, failed sobriety tests at the scene, police said.
Briguglio's son, who complained of pain, was taken to a hospital for evaluation and was released, according to police.
Briguglio was charged with driving while intoxicated and aggravated driving while intoxicated with a child passenger, Leandra's Law.
Under Leandra's Law, driving drunk with a passenger age 15 or younger is a felony. The law was passed in 2009 after Leandra Rosado, 11, was killed in an DWI accident after the minivan in which she was a passenger crashed in Manhattan.
Briguglio is scheduled to be arraigned Saturday in First District Court in Hempstead.
